(A consumer is any natural person who concludes a legal transaction for purposes that can be attributed neither predominantly to their commercial nor to their self-employed professional activity.)

You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day

on which you, or a third party other than the carrier and indicated by you, acquired physical possession of the goods, where you have ordered one or more goods as part of a single order and they are delivered together;

on which you, or a third party other than the carrier and indicated by you, acquired physical possession of the last of the goods, where you have ordered several goods as part of a single order and they are delivered separately;

To exercise your right of withdrawal, you must inform us (ITAA-System GmbH, Hoher Weg 28, 46446 Emmerich am Rhein, telephone: +49 2822 68204, e-mail address: info@itaa-system.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form, but it is not obligatory.

You may also exercise your right of withdrawal online, using a button labelled accordingly (“Withdraw from contract” or a similar label) on our website (itaa-system.de (https://itaa-system.de)). If you use this online function, we will send you without delay, on a durable medium (e.g. by e-mail), an acknowledgement of receipt with information on the content of the declaration of withdrawal and the date and time of its receipt.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we receive the notification of your withdrawal from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

For goods suitable for dispatch by parcel, we may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier.

We will collect the goods that are not suitable for dispatch by parcel.

You shall send back or hand over to us the goods suitable for dispatch by parcel without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods suitable for dispatch by parcel before the period of 14 days has expired.

We will bear the cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusions and grounds for expiry

The right of withdrawal does not apply to contracts

for the supply of goods that are not prefabricated and for whose production an individual selection or decision by the consumer is decisive, or that are clearly tailored to the personal needs of the consumer;
for the supply of goods that are liable to deteriorate or expire rapidly;
for the supply of alcoholic beverages, the price of which was agreed upon at the conclusion of the contract, the delivery of which can only take place after 30 days from the conclusion of the contract, and the actual value of which is dependent on fluctuations in the market which cannot be controlled by the trader;
for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.

The right of withdrawal expires prematurely in the case of contracts

for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons, if their seal was broken after delivery;
for the supply of goods which, after delivery, have by their nature been inseparably mixed with other items;
for the supply of sound or video recordings or computer software in a sealed package, if the seal was broken after delivery.

If you requested that the services, for which the contract provides for the payment of a price, begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until the time you inform us of your exercise of the right of withdrawal from this contract, in comparison with the full coverage of the services provided for in the contract.

Exclusions and grounds for expiry

The right of withdrawal does not apply to contracts for the provision of services in connection with leisure activities, if the contract provides for a specific date or period of performance.

The right of withdrawal expires in the case of a contract for the provision of services which obliges the consumer to pay a price, once the service has been fully provided, if the consumer expressly agreed before the performance began that the trader may begin to perform the service before the withdrawal period has expired, and confirmed their awareness that their right of withdrawal expires once the contract has been fully performed by the trader.
